I separated from husband in 2008 & moved to Weymouth, MA from NY.

Additional Information:

I haven’t spoken to him since.  How can I get divorced if we have no contact? We did not have any children from marriage but I do have a ten year old from previous. We parted in ill terms & I have no way of contacting this man as I do not know where he moved to after I left. How hard is it to get a divorce in the State of Mass?

ATTORNEY ANSWER:

You may file for divorce in Massachusetts once you have lived here for at least one year.  The Probate & Family Court upon motion will allow you to carry out service of your Complaint For Divorce upon your husband by publication: that is, you will mail to his last known address and you will publish a notice of the divorce action in a suitable newspaper selected by the Court, and then submit proof of publication to the clerk’s office. Finally, you ask about how easy it is to obtain a divorce in Massachusetts. The most likely basis for divorce you’ll use, Irretrievable Breakdown, requires a six-month wait between the filing of the Complaint and the Hearing at which the Court will enter its decree. Apart from that wait, the other steps in the process are relatively easy and inexpensive.
